Free2Grow's Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website at www.free-2-grow.com (the “Site”) and the products and services offered by Free2Grow (“Free2Grow,” “we,” “us,” or “our”), including our AI Voice CSR, Speed2Lead, Outbound, Webchat, and CSR Assist products (collectively, the “Services”). By accessing the Site or using the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Site or Services. If you use the Services on behalf of a business, you represent that you are authorized to bind that business, and “you” includes that business. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. The Services

Free2Grow provides an AI-powered customer service platform that answers inbound calls, engages via web chat, places outbound calls and text messages, books appointments, integrates with Client CRM and field-management systems, and provides performance analytics. Specific features, availability, and integrations may change over time. Access to paid Services requires a separate order, subscription, or written agreement, which, if it conflicts with these Terms, controls with respect to the paid Services.

3. Client Responsibilities and Acceptable Use

You agree to use the Site and Services lawfully and only as permitted. You will not, and will not permit others to:

Use the Services in violation of any applicable law, including telemarketing, call-recording, consumer-protection, and privacy laws;
Place outbound calls or texts without obtaining and maintaining all legally required consents, or in violation of do-not-call or opt-out obligations;
Record calls without providing any legally required notice or consent;
Upload or transmit unlawful, infringing, harassing, or harmful content, or malware;
Attempt to reverse engineer, decompile, scrape, or gain unauthorized access to the Services or their underlying models and infrastructure;
Resell, sublicense, or provide the Services to third parties except as expressly permitted; or
Interfere with or disrupt the integrity or performance of the Services.

As between you and Free2Grow, you are solely responsible for the accuracy and legality of the data, scripts, call flows, and contact lists you provide, and for your compliance with laws applicable to your calls and messages, including the Telephone Consumer Protection Act (TCPA) and applicable recording-consent laws.

3. Client Responsibilities and Acceptable Use

The Services use artificial intelligence to conduct automated voice and text conversations and to generate transcripts, summaries, and analytics. AI systems can produce errors, misunderstand callers, or generate inaccurate output. You are responsible for configuring escalation rules and for reviewing and supervising the AI’s performance for your business. The Services do not provide legal, financial, medical, or other professional advice, and outputs should not be relied upon as such. Free2Grow does not guarantee any specific booking rate, close rate, response time, or business result; any statistics presented are illustrative and not a promise of performance.

5. Third-Pary Integrations

The Services integrate with third-party platforms, including CRM and field-management systems (such as ServiceTitan, Housecall Pro, FieldPulse, and FieldEdge) and lead sources (such as Angi, Yelp, Google, and Facebook). Your use of those platforms is governed by your agreements with them. Free2Grow is not responsible for the availability, accuracy, or actions of third-party platforms, and integration functionality may change if a third party alters or discontinues its services.

6. Fees and Payment

Fees for paid Services are set out in the applicable order or subscription. Unless otherwise stated, fees are billed on a recurring flat-rate basis based on the number of technicians in your business, are non-refundable except as required by law, and are exclusive of applicable taxes. We may change fees on renewal with prior notice as set out in your agreement. Late or failed payments may result in suspension of the Services.

7. Intellectual Property

The Site and Services, including all software, AI models, text, graphics, logos, and the “Free2Grow” name and marks, are owned by Free2Grow or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services during your subscription solely for your internal business purposes. You retain ownership of the data you submit (“Client Data”) and grant us a license to use Client Data to provide, maintain, secure, and improve the Services as described in our Privacy Policy. This license includes the right to use Client Data and interaction content (including calls, transcripts, and messages) to train and improve the AI models that power the Services for Free2Grow and its Clients generally, using de-identified or aggregated data where practicable.

8. Confidentiality

Each party may receive confidential information of the other. The receiving party will use such information only to perform under these Terms and will protect it with reasonable care. This obligation does not apply to information that is public through no fault of the receiving party, independently developed, or required to be disclosed by law.

9. Privacy

Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference. Where Free2Grow processes personal information on your behalf, the parties will comply with applicable data-protection laws and, where required, enter into a data processing addendum.

10. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FREE2GROW DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREE2GROW AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR SERVICES. FREE2GROW’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO FREE2GROW FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Free2Grow and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your Client Data, your calls and messages (including TCPA and call-recording claims), or your violation of these Terms or applicable law.

13. Term, Suspension, and Termination

These Terms apply while you access the Site or use the Services. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or fail to pay fees when due. You may stop using the Services at any time; paid subscriptions terminate as provided in your order or agreement. Upon termination, your right to use the Services ends, and we will handle Client Data as described in our Privacy Policy and applicable agreement. Sections that by their nature should survive termination will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Except where prohibited, the parties agree that the state and federal courts located in the City of St. Louis, Missouri will have exclusive jurisdiction over any dispute not subject to arbitration, and each party consents to personal jurisdiction there.

15. Changes to the Services and Terms

We may modify the Site, the Services, or these Terms at any time. When we change these Terms, we will update the “Effective Date” above and, where appropriate, provide additional notice. Your continued use after changes take effect constitutes acceptance of the revised Terms.

16. General

These Terms, together with any order, subscription, or agreement and our Privacy Policy, are the entire agreement between you and Free2Grow regarding the Site and Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship.
